Debt collection and enforcement

Recover what you are owed, through the route that best fits your case.

A loan that was never repaid, a bounced check, an overdue promissory note or a judgment the other party ignores: being in the right is not enough if you can’t collect.

Summary collection proceedings (juicio ejecutivo) are faster than an ordinary lawsuit and are designed to collect debts recorded in documents such as checks, promissory notes or certificates. And when you already have a judgment in your favor, you can ask for it to be enforced.

Our team reviews your documents, chooses the most effective route and, where appropriate, requests measures to secure payment, such as attachment of the debtor’s assets.

In which cases?

  • You are owed money and have a document to back it up.
  • You have a bounced check or an unpaid promissory note.
  • You won a court case and the other party won't pay.
  • You need to collect unpaid invoices.

We send the debtor a formal demand and seek a payment agreement.

Don’t worry if you don’t have everything: we will go through it together at the consultation.

Frequently asked questions

What are summary collection proceedings?

They are a faster process than an ordinary lawsuit, used to collect debts recorded in certain documents, such as checks or promissory notes.

What is an attachment?

It is a measure that freezes the debtor's assets or funds to make sure the debt can be collected.

Do debts expire?

Yes: the law sets time limits for making a claim, which vary depending on the type of debt. That is why it is best to seek advice early.
